1. Acceptance of Terms

By accessing or using the HerHealth Pharmacy website (herhealthphar.com) and our services, you agree to be bound by these Terms of Use, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our website or services.

We may update these Terms of Use from time to time. Material changes will be communicated to you in advance by email or through a notice on our website. Non-material updates take effect upon posting. Your continued use of our services after notice of any change constitutes your acceptance of the revised terms.

2. Eligibility

To use our services, you must:

  • Be at least 18 years of age or the age of majority in the Province of Ontario.
  • Be a resident of Canada with a valid Canadian mailing address.
  • Have the legal capacity to enter into a binding agreement.
  • Provide accurate and truthful information when creating an account or placing an order.

By using our services, you represent and warrant that you meet all eligibility requirements.

3. Account Responsibilities

When you create an account with HerHealth Pharmacy, you are responsible for:

  • Maintaining the confidentiality of your login credentials (email and password).
  • All activities that occur under your account.
  • Ensuring that all information provided is accurate, current, and complete.
  • Notifying us immediately of any unauthorized use of your account or any other security breach.
  • Updating your account information promptly if there are any changes to your personal details, health information, or contact information.

We reserve the right to suspend or terminate your account if we suspect fraudulent activity, misuse, or violation of these terms.

4. Prescription and Telehealth Services

HerHealth Pharmacy is a licensed pharmacy in the Province of Ontario. Our services are subject to the following conditions:

  • Valid prescription required: all prescription medications require a valid prescription issued by a licensed Canadian healthcare provider. We will verify all prescriptions before dispensing.
  • Questionnaire-based assessments: medical questionnaires on our website are used to gather health information to assist our pharmacists. A questionnaire response alone does not constitute a prescription, and medication will not be dispensed based solely on questionnaire responses without proper clinical authorization.
  • Pharmacist review: all orders involving prescription medications are reviewed by a licensed pharmacist before dispensing.
  • Telehealth services: virtual consultations (video, secure messaging, telephone) require a separate Telehealth Consent before your first session. Telehealth is not appropriate for emergencies — if you are experiencing a medical emergency, call 911 or go to your nearest emergency department.
  • Right to refuse: our pharmacists and prescribers reserve the right to refuse to fill any prescription or provide any service if, in their professional judgment, doing so would not be in the best interest of the patient.
  • Prescription transfers: prescription transfers are handled in accordance with Ontario pharmacy regulations.

5. Prohibited Uses

You agree not to use our website or services to:

  • Provide false, misleading, or fraudulent information, including false identity or prescription information.
  • Attempt to obtain prescription medications without a valid prescription.
  • Resell, redistribute, or share medications obtained through our pharmacy.
  • Interfere with or disrupt the operation of our website or servers.
  • Attempt to gain unauthorized access to any part of our website, systems, or databases.
  • Use automated tools (bots, scrapers) to access or collect data from our website without our prior written consent.
  • Engage in any activity that violates applicable federal, provincial, or local laws or regulations.
  • Harass, threaten, or abuse our staff or other users.

6. Intellectual Property

All content on the HerHealth Pharmacy website, including text, graphics, logos, images, and software, is the property of HerHealth Pharmacy or its content suppliers and is protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written consent.

7. Limitation of Liability

The provisions of this section apply to your use of our website and online ordering platform. They do not limit our duties as a regulated pharmacy or any liability arising from professional pharmacy services, which are governed by the Pharmacy Act, the Drug and Pharmacies Regulation Act, and the standards of practice of the Ontario College of Pharmacists.

To the maximum extent permitted by law, in respect of your use of our website and ordering platform:

  • The website and online services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website.
  • Our total liability for any claim arising from website availability or order processing shall not exceed the amount you paid for the specific product or service giving rise to the claim.
  • We are not liable for delays in delivery caused by shipping carriers, weather, or other circumstances beyond our control.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for our obligations under Ontario consumer protection legislation, or for any liability that cannot be excluded by law.

8. Indemnification

You agree to indemnify and hold harmless HerHealth Pharmacy, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your fraudulent or unauthorized use of our website or services;
  • Information you provide that is materially false or misleading;
  • Your violation of these Terms of Use; or
  • Your violation of the rights of any third party.

This indemnity does not apply to claims arising from our own negligence or wilful misconduct, or to claims relating to professional pharmacy services.

9. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.

10. Severability

If any provision of these Terms of Use is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
